WYKR General Contest Rules

These General Contest Rules apply to contests, giveaways, drawings, call-in promotions, online promotions, and other prize promotions conducted by WYKR-FM 101.3, unless separate or additional rules are announced or posted for a particular contest.

By entering or participating in a WYKR contest, participants agree to be bound by these General Contest Rules and any specific rules announced or posted for that contest.

1. No Purchase Necessary

No purchase is necessary to enter or win a WYKR contest.

Making a purchase will not increase a participant's chances of winning.

Certain methods of entry, including text messaging, internet access, or telephone calls, may be subject to normal charges imposed by the participant's telephone, wireless, or internet provider.

2. Eligibility

Unless otherwise stated for a particular contest, WYKR contests are open to legal residents of Vermont and New Hampshire who are 18 years of age or older at the time of entry.

Additional age, residency, licensing, or other eligibility requirements may apply to individual contests and will be disclosed with those contests.

Employees of WYKR, its affiliated companies, participating sponsors, advertising agencies, promotional partners, and members of their immediate families or households are not eligible to participate unless otherwise stated.

For purposes of these rules, immediate family includes spouses, parents, children, siblings, grandparents, grandchildren, and persons residing in the same household.

3. Limit on Winning

Unless otherwise stated in the specific rules for a contest, an individual may win a WYKR contest or giveaway no more than once within any 30-day period.

This restriction also applies to members of the same household. Only one prize per household within any 30-day period is permitted, regardless of which household member enters or wins.

A household means individuals who reside at the same physical address.

If a person or household is selected as a potential winner but has already won a WYKR prize within the previous 30 days, that person may be declared ineligible and another winner may be selected.

WYKR may establish a different winning-frequency restriction for a particular contest, including longer waiting periods for major prizes, trips, event packages, or other high-value giveaways. Any different restriction will be included in the specific rules for that contest.

Winning a prize from another radio station, newspaper, sponsor, or organization does not affect eligibility for a WYKR contest unless specifically stated otherwise.

WYKR's records regarding previous winners and prize eligibility will control in determining whether a participant is eligible to win.

4. How to Enter

The method of entry will be announced on WYKR and/or described on wykr.com for each contest.

Entry methods may include, but are not limited to:

  • Calling the radio station
  • Entering through wykr.com
  • Entering through the WYKR mobile app
  • Text messaging
  • Social media participation
  • Registering at a WYKR remote broadcast or community event
  • Completing an entry form at a participating business
  • Other methods announced as part of the promotion

Entries must be received during the announced contest period.

WYKR is not responsible for incomplete, lost, late, misdirected, corrupted, interrupted, or technically unsuccessful entries.

Entry limits, if applicable, will be announced or posted as part of the individual contest.

Automated entries, scripts, bots, fraudulent entries, or attempts to manipulate a contest may result in disqualification.

5. Call-In Contests

For contests requiring listeners to call the station, the designated caller number announced on the air will be considered the potential winner, subject to verification of eligibility.

Listeners should not place themselves or others in danger while attempting to participate.

WYKR is not responsible for telephone equipment failures, busy signals, dropped calls, cellular service interruptions, internet telephone delays, or other circumstances that may prevent a caller from reaching the station.

The determination of WYKR staff concerning the designated caller is final.

6. Contest Deadlines

The beginning and ending dates and times for each contest will be announced on the air, posted online, or included in the contest's specific rules.

Entries received before or after the announced contest period may be disqualified.

All times are Eastern Time unless otherwise stated.

7. Winner Selection

Winners will be selected according to the method announced for each contest.

Depending upon the promotion, winners may be determined by random drawing, designated caller number, trivia question, judging, voting, skill, or another announced method.

In the event of a tie, WYKR may use an additional question, random drawing, or another reasonable tie-breaking method consistent with the contest.

WYKR's decisions regarding the administration of a contest, eligibility of participants, and selection of winners are final, subject to applicable law.

8. Prizes

The prize or prizes available in each contest, along with their approximate retail value when applicable, will be announced on the air, posted online, or included in the specific contest rules.

Prizes are awarded as described and may not be exchanged for cash unless specifically authorized by WYKR or the prize provider.

WYKR or the participating sponsor may substitute a prize of comparable or greater value when the originally advertised prize becomes unavailable for reasons beyond its reasonable control.

Prizes may not be transferred or sold unless specifically permitted.

Any expenses associated with accepting or using a prize that are not specifically included as part of the prize are the responsibility of the winner.

Gift certificates, event tickets, merchandise, services, and other prizes may also be subject to terms, expiration dates, restrictions, or conditions established by the business or organization providing the prize.

9. Claiming a Prize

Winners may be required to provide valid identification and proof of eligibility before receiving a prize.

Winners may also be required to complete appropriate prize, eligibility, release, or tax documentation.

Unless a different deadline is stated for a particular contest, prizes should be claimed within 30 days after the winner is notified.

If a winner cannot be contacted, does not respond within the required period, does not meet eligibility requirements, or fails to claim the prize within the required period, the prize may be forfeited and WYKR may select an alternate winner.

Prize pickup or delivery instructions will be provided to the winner.

WYKR is not responsible for lost, stolen, damaged, misplaced, or expired prizes after they have been provided to the winner.

10. Taxes and Expenses

Winners are responsible for all federal, state, and local taxes or other obligations associated with receiving a prize.

WYKR or the prize provider may require tax information from a winner and may issue tax reporting documents when required by law.

Unless specifically stated otherwise, transportation, meals, lodging, parking, fees, gratuities, and other expenses associated with accepting or using a prize are the responsibility of the winner.

11. Publicity

Except where prohibited by law, acceptance of a prize constitutes permission for WYKR and participating sponsors to use the winner's name, hometown, voice, photograph, image, or likeness in connection with the contest and its promotion without additional compensation.

This may include on-air announcements, website posts, social media posts, photographs, audio, or video relating to the promotion.

12. Social Media Contests

When a contest is conducted through Facebook, Instagram, YouTube, TikTok, X, or another social media platform, the promotion is not sponsored, endorsed, administered by, or associated with that platform unless specifically stated otherwise.

Participants release the applicable social media platform from responsibility relating to the administration of the contest to the extent permitted by law.

Participants must also comply with the rules and terms of the applicable social media platform.

13. Technical Problems

WYKR is not responsible for problems caused by telephone networks, internet connections, websites, mobile applications, computer systems, social media platforms, wireless carriers, electrical outages, equipment failures, or other technical circumstances outside WYKR's reasonable control.

WYKR is also not responsible for calls, messages, entries, or submissions that are delayed, lost, incomplete, misdirected, or not received due to technical problems.

If technical problems or other circumstances affect the fairness or operation of a contest, WYKR may take reasonable steps to correct the situation.

14. Conduct and Disqualification

WYKR reserves the right to disqualify any person who:

  • Provides false or misleading information
  • Attempts to enter using multiple identities when prohibited
  • Attempts to circumvent the 30-day winning limitation
  • Uses another household member's name to avoid eligibility restrictions
  • Attempts to manipulate or interfere with a contest
  • Uses automated entry methods when they are not permitted
  • Violates these General Contest Rules or specific contest rules
  • Engages in threatening, abusive, disruptive, or fraudulent conduct in connection with a contest

WYKR reserves the right to determine whether an entry complies with the applicable contest rules.

15. Changes, Suspension, or Cancellation

WYKR may modify, suspend, postpone, or cancel a contest when circumstances beyond its reasonable control make it necessary to do so, including technical failures, severe weather, emergencies, prize unavailability, fraud, or other circumstances affecting the fair administration of the contest.

Any material changes to the contest terms will be disclosed on WYKR and/or wykr.com as required.

16. Release of Liability

To the extent permitted by law, participants and winners agree that WYKR, its owners, affiliated companies, participating sponsors, promotional partners, prize providers, and their respective employees, officers, agents, and representatives are not responsible for injury, loss, damage, or other claims arising from participation in a contest or the acceptance, possession, use, or misuse of a prize, except where liability cannot legally be excluded.

17. Sponsor-Provided Prizes

Some prizes offered through WYKR contests are provided by local businesses, organizations, event promoters, or other third parties.

WYKR does not manufacture or provide those goods or services and is not responsible for changes in operating hours, cancellations, product availability, expiration dates, service availability, or other conditions imposed by the prize provider.

Any dispute regarding the actual goods or services provided as part of a prize may need to be addressed directly with the prize provider.

18. Specific Contest Rules

Individual contests may have additional rules, restrictions, deadlines, eligibility requirements, prize conditions, or methods of entry.

When specific rules are provided for an individual contest, those rules are incorporated into these General Contest Rules.

If there is a conflict between these General Contest Rules and the specific rules announced or posted for a particular contest, the specific contest rules will control.

19. Privacy

Information submitted in connection with a contest may be used by WYKR to administer the contest, verify eligibility, contact winners, and award prizes.

Contest entry does not automatically constitute consent to receive unrelated advertising or marketing communications unless the participant separately agrees to receive them.

Information may be shared with a participating sponsor or prize provider when reasonably necessary to fulfill or deliver a prize.

20. Odds of Winning

Odds of winning depend upon the nature of the contest and, when applicable, the number of eligible entries received.

For call-in contests, odds depend upon the number of listeners attempting to participate and successfully reaching the station.

21. Decisions of WYKR

All interpretations of these rules and decisions made by WYKR regarding eligibility, entries, winner selection, prize fulfillment, and administration of a contest are final, subject to applicable law.

WYKR reserves the right to correct clerical, printing, production, or typographical errors in contest materials when doing so does not materially disadvantage participants.

Questions concerning a WYKR contest may be directed to the station using the contact information provided at wykr.com.

Specific contest rules and material terms will be made available as required and may remain posted following the conclusion of a contest in accordance with applicable FCC requirements.

These General Contest Rules may be updated from time to time. The rules in effect at the time of a particular contest, together with any specific rules for that promotion, will govern that contest.
